Terms of Service

These Terms of Service ("Terms") govern your use of the SILLIVE platform ("the Platform"), operated by Gautam Aust Pty Ltd (ABN 23 664 289 892), trading as Caring Hands SA ("we", "us", "our").

By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. About SILLIVE

SILLIVE is a SIL (Supported Independent Living) transparency and evidence platform designed for NDIS providers, support coordinators, and support workers in Australia. The Platform facilitates shift management, participant care documentation, compliance tracking, and communication between providers and support coordinators.

2. Eligibility

You must be at least 18 years of age and based in Australia to use the Platform. By using the Platform, you represent that you have the authority to agree to these Terms on behalf of yourself or the organisation you represent.

3. Account Types

The Platform supports three account types:

• Provider: NDIS-registered SIL providers who manage participants, workers, rosters, and billing.
• Support Coordinator (SC): NDIS support coordinators who monitor participant progress and receive reports from providers.
• Support Worker: Staff employed or contracted by providers who deliver direct support and log shift notes.

4. Your Responsibilities

When using the Platform, you agree to:

• Provide accurate and current information in your account and any records you create.
• Keep your login credentials secure and not share them with others.
• Use the Platform only for lawful purposes related to NDIS service delivery.
• Comply with all applicable NDIS Practice Standards, the Privacy Act 1988, and relevant state and territory legislation.
• Not attempt to access data belonging to other providers, participants, or users that you are not authorised to view.
• Report any security incidents, data breaches, or unauthorised access immediately to hello@sillive.com.au.

5. Participant Data

Participant information entered into the Platform (including NDIS numbers, care plans, medical details, and incident reports) is sensitive and protected under Australian privacy law. You must:

• Only enter participant data that you are authorised to record as part of your service delivery role.
• Not download, share, or distribute participant data outside the Platform except as required for NDIS reporting or with the participant's consent.
• Ensure all information recorded is accurate, professional, and relevant to the participant's care.

6. Provider Obligations

Providers using the Platform are responsible for:

• Ensuring all workers they invite to the Platform are legitimate employees or contractors.
• Reviewing and approving support coordinator connection requests.
• Maintaining accurate participant records and rosters.
• Ensuring their use of the Platform complies with NDIS registration requirements.

7. Pricing and Payment

SILLIVE is offered on a per-participant monthly subscription basis. Current pricing tiers are published on the Platform. We reserve the right to change pricing with 30 days' written notice. Non-payment may result in suspension of access.

8. Data Ownership

You retain ownership of all data you enter into the Platform. We do not claim ownership of your participant records, shift notes, or documents. We store and process your data solely to provide and improve the Platform.

9. Availability and Support

We aim to keep the Platform available 24/7 but do not guarantee uninterrupted access. We may perform maintenance with or without notice. We are not liable for losses caused by downtime, data delays, or technical issues.

10. Intellectual Property

The Platform, including its design, code, branding, and documentation, is owned by Gautam Aust Pty Ltd. You may not copy, modify, reverse-engineer, or create derivative works from any part of the Platform without our written consent.

11. Limitation of Liability

To the maximum extent permitted by Australian law:

• The Platform is provided "as is" without warranties of any kind.
• We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform.
• Our total liability for any claim related to the Platform is limited to the fees you have paid us in the 12 months preceding the claim.
• SILLIVE is a record-keeping and communication tool — it does not replace clinical judgement, NDIS compliance obligations, or professional supervision.

12. Termination

You may close your account at any time by contacting us. We may suspend or terminate your access if you violate these Terms, fail to pay fees, or use the Platform in a way that harms other users or the Platform itself. On termination, we will retain your data in accordance with our Privacy Policy and NDIS record-keeping requirements.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of South Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of South Australia.
